Chairperson of the National Council of Provinces (NCOP), Thandi Modise, has noted the Supreme Court of Appeal’s dismissal of her appeal against a high court ruling that found EFF leader Julius Malema was justified in refusing to withdrew a statement during a sitting in August last year.
Modise declared Malema’s statement that the “ANC government massacred” the mineworkers at Marikana as unparliamentary and unlawful. She then asked him to withdraw the statement and, upon his refusal, asked him to leave the National Assembly.
Judge Visvanathan Ponnan this morning dismissed Modise's appeal with costs.
Her spokesperson, Tshepiso Sheunyane, says Modise will study the ruling.
